Welcome to TEXAS LAND CLEARING SOLUTIONS, LLC (“we,” “our,” or “us”). These Terms of Service (“Terms”) govern your use of our services, website, communication platforms, and any interaction you have with our team. By accessing or using our services, you agree to these Terms.
1. Services Provided
We provide property improvement services including land clearing, cedar mulching, brush removal, and related site work. Services may vary by region and availability.
2. Lead Submission and Contact Authorization
By submitting your contact information through our website, Facebook form, or any other lead form, you:
- Represent that the information provided is accurate and your own.
- Agree to be contacted via phone, text message, and email regarding our services, including marketing or promotional communications (some of which may be automated).
- Understand that message and data rates may apply and that you can reply “STOP” to unsubscribe at any time
3. Scheduling and Site Visits
After submitting your request, a team member will contact you to schedule a property visit. These site visits are for informational and consultation purposes only and do not constitute a commitment or guarantee of service.
4. Quotes and Payment Terms
Quotes provided after a site visit are estimates and subject to change based on actual site conditions.
All work will be governed by a separate written service agreement before the project begins.
Payment terms, deposits, and refund policies will be included in that written agreement. Deposits may be non-refundable unless otherwise agreed.
We may suspend or delay services if payment is late.
5. No Guarantees or Warranties
We strive to provide high-quality service, but land conditions vary. All services are provided on an “as-is” basis. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee specific results, timelines, or outcomes of land improvement services.
6. User Responsibilities
You agree not to:
- Provide accurate information when submitting forms or requests.
- Obtain any necessary permits, approvals, or permissions required for services.
- Ensure property access (e.g., unlocked gates, secured pets, removal of obstacles).
- Identify or disclose the presence of underground utilities, hazards, or obstructions before work begins (unless we expressly handle 811 or similar calls).
- Refrain from harassing, abusing, or threatening any employee, scheduler, or subcontractor.
- Not interfere with our systems or attempt unauthorized access to company information.
7. Privacy and Data Use
We collect and use personal information in accordance with our Privacy Policy. By using our services, you consent to the collection and use of data as described in that policy.
8. Limitation of Liability
To the fullest extent permitted by law:
- We are not liable for any indirect, incidental, special, or consequential damages arising out of or related to the use of our services.
- We are not liable for delays, weather events, equipment failures, or acts of third parties outside our reasonable control.
- Our total liability under any cause of action shall not exceed the amount you paid us for services in the six months prior to the event giving rise to the claim.
- We are not liable for property damage except where caused by our gross negligence or intentional misconduct.
9. Dispute Resolution: Binding Arbitration & Class Action Waiver
PLEASE READ THIS SECTION CAREFULLY — IT AFFECTS YOUR LEGAL RIGHTS.
By using our services, you agree that any dispute, claim, or controversy arising out of or relating to your use of TEXAS LAND CLEARING SOLUTIONS, LLC’s services shall be resolved exclusively through binding individual arbitration, and not in court.
Arbitration Agreement
- All disputes shall be resolved by final and binding arbitration administered by the American Arbitration Association (AAA) under its Commercial Arbitration Rules, or by another mutually agreed-upon arbitration service.
- The arbitration will take place in Travis County, Texas, in English.
- The arbitrator may award any remedy available under applicable law. The decision will be final and binding, and judgment may be entered in any court with jurisdiction.
- Each party will bear its own attorneys’ fees and costs unless otherwise awarded by the arbitrator.
Class Action Waiver
You agree to bring claims only in your individual capacity and not as a plaintiff or class member in any class, collective, or representative proceeding.
The arbitrator shall not have authority to hear or arbitrate any class or representative actions.
If a court or arbitrator finds this waiver unenforceable, this entire arbitration section shall be null and void.
Exception – Small Claims Court
Either party may bring an eligible claim in small claims court in Travis County, Texas, provided it is filed on an individual basis.
10. Governing Law
These Terms are governed by the laws of the State of Texas, without regard to its conflict of laws principles. Any claims not subject to arbitration shall be brought exclusively in the state or federal courts located in Travis County, Texas.
11. Force Majeure
We are not liable for any failure or delay in performance caused by events beyond our reasonable control, including but not limited to weather, natural disasters, labor disputes, equipment failures, supply shortages, or government actions.
12. Severability
If any provision of these Terms is found unenforceable, the remaining provisions shall remain in full force and effect.
13. Entire Agreement
We are not liable for any failure or delay in performance caused by events beyond our reasonable control, including but not limited to weather, natural disasters, labor disputes, equipment failures, supply shortages, or government actions.
14. Changes to These Terms
We may update these Terms from time to time. Continued use of our services after changes are posted constitutes acceptance of the updated Terms.
