TEXAS LAND CLEARING SOLUTIONS, LLC provides property improvement services including land clearing, cedar mulching, brush removal, and related site work. Services may vary by region and availability.
2. Lead Submission and Contact Authorization
By submitting your contact information through our website, Facebook form, or any other lead form, you:
- Represent that the information provided is accurate and your own
- Agree to be contacted via phone, text message, and email regarding our services, including marketing or promotional communications (some of which may be automated)
- Understand that message and data rates may apply and that you can reply “STOP” to unsubscribe at any time
3. Scheduling and Site Visits
After submitting your request, a TEXAS LAND CLEARING SOLUTIONS, LLC team member will contact you to schedule a property visit. These site visits are for informational and consultation purposes only and do not constitute a commitment or guarantee of service.
4. Quotes and Payment Terms
Quotes provided after a site visit are estimates and subject to change based on actual site conditions. All work will be governed by a separate written agreement before the project begins. Payment terms, deposits, and refund policies will be included in that agreement.
5. No Guarantees or Warranties
We strive for high-quality service, but land conditions vary, and we make no warranties or guarantees regarding the outcome, timeline, or specific results of land improvement services.
6. User Responsibilities
You agree not to:
- Submit false information through our lead forms
- Harass, abuse, or threaten any employee, scheduler, or subcontractor
- Interfere with our systems or attempt to gain unauthorized access to company information
7. Privacy and Data Use
We collect and store information in accordance with our Privacy Policy. By using our services, you consent to the collection and use of data as outlined there.
8. Limitation of Liability
To the fullest extent permitted by law, TEXAS LAND CLEARING SOLUTIONS, LLC is not liable for any indirect, incidental, or consequential damages arising out of or related to the use of our services. Our total liability under any cause of action shall not exceed the amount you paid us for services in the past six months.
9. Dispute Resolution: Binding Arbitration & Class Action Waiver
PLEASE READ THIS SECTION CAREFULLY — IT AFFECTS YOUR LEGAL RIGHTS.
By using our services, you agree that any dispute, claim, or controversy arising out of or relating to your use of TEXAS LAND CLEARING SOLUTIONS, LLC’s services, including any communications, contracts, transactions, or interactions with the company, shall be resolved exclusively through binding individual arbitration, and not in court.
Arbitration Agreement
- All disputes shall be resolved by final and binding arbitration administered by the American Arbitration Association (AAA) under its Commercial Arbitration Rules, or by a mutually agreed-upon arbitration service.
- The arbitration will take place in Travis County, Texas, and will be conducted in English.
- The arbitrator shall have the authority to grant all remedies available under applicable law, and their decision shall be final and binding. Judgment may be entered in any court having jurisdiction.
Class Action Waiver
You and TEXAS LAND CLEARING SOLUTIONS, LLC agree that any claims or disputes must be brought only in your individual capacity and not as a plaintiff or class member in any purported class, collective, or representative proceeding. The arbitrator shall not have authority to hear or arbitrate any class or collective actions.
If a court or arbitrator determines that the class action waiver is unenforceable, this entire arbitration agreement shall be null and void.
Exception – Small Claims Court
Either party may bring a claim in small claims court in Travis County, Texas, if the claim qualifies and is brought on an individual basis.
10. Changes to These Terms
We reserve the right to update these Terms at any time. Continued use of our services after changes means you accept the new Terms.
